1. Who we are
The KOLBOS online store is operated by:
- [Company name]
- Registered address: [Address]
- Registration number: [Registration number]
- VAT/OSS number: [VAT/OSS number]
- Email: [Email]
- Phone: [Phone]
In these Terms, "we", "us" and "our" refer to [Company name]. "You" refers to the customer placing an order.
2. Scope
These Terms & Conditions apply to all orders placed through the KOLBOS website by consumers resident in a member state of the European Union. A consumer is a natural person who buys goods for purposes that are mainly outside their trade, business, craft or profession.
Our store is intended for consumers only. Please read these Terms together with our Returns & Right of Withdrawal, Shipping & Delivery and Privacy Policy pages, which form part of these Terms.
3. Products
We sell home fitness equipment, scooters, camping gear and other consumer products. Product images are illustrative; minor differences in colour or appearance may occur. The main characteristics of each product are described on its product page.
Goods are shipped directly from our suppliers' warehouses located within the EU. This does not affect your rights against us: we remain your contracting party and are responsible for the performance of the contract.
4. Ordering and contract formation
- You select products, add them to the cart and proceed to checkout.
- Before submitting your order, you can review and correct all details, including products, quantities, delivery address and total price.
- By clicking the order button (for example "Place order and pay"), you submit a binding offer to purchase the products in your cart.
- We send an automatic email confirming receipt of your order. This acknowledgement is not yet an acceptance of your offer.
- The contract is concluded when we confirm acceptance of your order by email or when we dispatch the goods, whichever occurs first. [legal review]
If a product is unavailable after you have ordered, we will inform you promptly and refund any payment already made without undue delay.
The contract language is English. We store the contract text, and you will receive the order details and these Terms by email.
5. Prices and VAT
All prices are shown in euros (EUR) and include VAT. The VAT rate applied is the rate of the EU member state to which the goods are delivered. [legal review]
Shipping within the EU is free. There are no additional customs duties or import charges for deliveries within the EU, as the goods are shipped from inside the EU.
We reserve the right to correct obvious pricing errors. If an error affects your order, we will contact you before processing it, and you may cancel the order without charge.
6. Payment
Payment is made by credit or debit card. Payments are processed securely by our payment processor, SUMIT. We do not store your full card details.
Your card is charged when you place your order. [legal review] An invoice or receipt will be provided electronically.
7. Delivery
We deliver to addresses in EU member states. Orders are typically delivered within 2–5 business days after dispatch. Delivery times are estimates and are not guaranteed, unless expressly agreed. Full details are set out on our Shipping & Delivery page.
If we are unable to deliver within 30 days of the contract being concluded, or within any other period agreed with you, you may be entitled to terminate the contract and receive a refund. [legal review]
8. Transfer of risk
The risk of loss of or damage to the goods passes to you when you, or a third party designated by you (other than the carrier), acquire physical possession of the goods.
9. Right of withdrawal
As a consumer in the EU, you have the right to withdraw from the contract within 14 days without giving any reason. Full details, including how to exercise this right, the model withdrawal form and applicable exceptions, are set out on our Returns & Right of Withdrawal page.
10. Legal guarantee of conformity
We are responsible for ensuring that the goods conform to the contract. Under EU consumer law (Directive (EU) 2019/771), you benefit from a legal guarantee of conformity for at least two years from delivery. Your national law may provide longer periods or additional rights.
If the goods are not in conformity, you may, under the conditions set out by law, request repair or replacement, and where applicable a price reduction or termination of the contract with a refund.
To report a defect, please contact us at [Email] with your order number, a description of the issue and, where possible, photos.
Any commercial guarantee offered by a manufacturer is in addition to, and does not affect, your legal rights.
11. Liability
We are liable in accordance with applicable law. Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud, for defective products under product liability law, or for any other liability that cannot be excluded or limited under the mandatory law applicable to you. [legal review]
Please use all products in accordance with the manufacturer's instructions and safety warnings, particularly fitness equipment and scooters.
12. Complaints and dispute resolution
If you have a complaint, please contact us first through our contact page. We aim to respond within 1 business day.
As a consumer, you may also have the right to refer a dispute to an alternative dispute resolution (ADR) body in your country. We are [willing / not obliged] to participate in ADR proceedings. [legal review]
The status and availability of the European Commission's online dispute resolution (ODR) platform should be verified before publication, and this section updated accordingly. [legal review]
13. Governing law
These Terms are governed by the laws of [governing law]. [legal review] However, if you are a consumer habitually resident in an EU member state, this choice of law does not deprive you of the protection afforded by the mandatory provisions of the law of your country of residence.
Nothing in these Terms affects your statutory rights as a consumer.
14. Changes to these Terms
We may update these Terms from time to time. The version in force at the time you place your order applies to that order.
